It is important that you read the information below. This agreement is known as the Webxotic LLC
(“Webxotic”, “Company”, “We” or “Us”) Code of Conduct Agreement (the “Code of Conduct”).
By accessing our Websites and using our Services (defined below), you agree to be bound by the terms
and conditions of this Code of Conduct. When you use our Websites and Services, you are entering
into a binding legal agreement with Webxotic. If you disagree with any of the terms herein, please stop
accessing our Websites and stop using our Services.
We want to create safe, fun, and engaging experiences for all the users of the Webxotic website, located
at www.webxotic.com (the “Website”), our Gaming Website located at businessempires.net (the
“Gaming Website” and together the “Websites”), and when using our Services, such as our games,
mobile games, applications, products, virtual goods, goods, surveys, promotions, contests, community
support, related activity, and information offered by the Company (the “Services”). This Code of
Conduct is designed to help achieve that goal and applies to all users of Webxotic Websites and Services.
We reserve the right, in our sole and absolute discretion, to change, modify, add, or remove portions of
this Code of Conduct at any time, with or without notice. Changes to this Code of Conduct will be
posted to our Website. The User Agreement contains other requirements that, with this Code of
Conduct and other community standards, govern your use of the Websites and Services.
1. Minimum Code of Conduct Requirements
While using our Websites and Services, you must respect the rights of others and their rights to use and
enjoy the Services. To this end, you may not defraud, harass, threaten, intimidate, or cause distress
and/or unwanted attention to other users of the Services.
While using the Websites and Services, you are expected to: be considerate, respectful, and collaborative;
refrain from demeaning, discriminatory or harassing behavior and speech; be mindful of your fellow
participants; and alert Website or Services organizers if you notice a dangerous situation or someone in
distress.
You must follow the instructions of and be respectful to authorized personnel (e.g., game masters and
community managers) in connection with your use of the Websites and Services.
2. Consequences of Unacceptable Behavior
If We determine in our discretion that you failed to comply with our User Agreement or this Code of
Conduct or other online policies or community standards, We may, in our sole discretion, limit, suspend,
or terminate your access to the Websites and Services and/or take other remedial actions that We deem
appropriate (e.g., removing violative posts from forums, muting players, etc.) with or without notice and
at any time, including terminating your account.
Anyone who is asked to refrain from unacceptable behavior is expected to do so immediately.
3. Code of Conduct Prohibitions
In connection with our Services:
You may not use communication facilities made available as part of the Websites or Services to “troll”
other users or Webxotic personnel, such as by intentionally trying to instigate conflict, hostility, or
arguments, or by posting or sharing memetic images or phrases without substantive content,
intentionally seeking to cause unrest among users of the Services, or otherwise be disruptive.
You may not post or communicate any player’s real-world information (e.g., name, address, account
name, etc.) through our Services.
You may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, or racially
or ethnically offensive language.
You may not post or link to any sexually explicit, harmful, threatening, abusive, defamatory, obscene,
hateful, racially, or ethnically offensive, or objectionable, in a reasonable person’s view, imagery or
content.
You may not spam, flood, or make duplicate posts when using facilities for communication with other
users that We make available as part of the Services (e.g., chat functions, message boards, forums, wikis,
etc.). Creating multiple threads on the same topic does not make it more likely that a message will be
seen, but it does make it more likely that other users of the Services will be annoyed and irritated. If a
user creates multiple messages with the intention of drawing attention away from other messages,
disciplinary action will be taken.
You may not abuse formatting or other means of artificially drawing attention to a given message that
may be made available as part of the Services when communicating with other users.
You may not impersonate any other person, or employee, contractor, owner, or officer of Webxotic.
You may not violate any local, state, national, or international laws or regulations in connection with
your use of the Services.
You may not market, promote, advertise, or solicit products or services using the Services (e.g., on chat
channels, forums, etc.).
You may not modify or copy any part of our Services (including our Games, Virtual Goods, and
websites).
You may not buy, sell, trade, share, or transfer access to any Account, including operator accounts or
advertise the purchase, sale, or other transfer of the same.
You may not use real currency for trading when using the Services. Selling anything for real money (e.g.,
United States Dollars or Euros) or other currency (e.g., Bitcoin), be it digital items, Virtual Goods,
services, or physical products is not allowed.
You may not advertise the intent to or commit the act of buying or selling items for cash or currency or
trading items from one server to another.
You may not arrange for the exchange or transfer of any pirated or illegal software, product, or services
while using the Services.
You may neither organize nor be a member of any pledges or groups within the Services that are based
on or espouse any racist, sexist, anti-religious, anti-ethnic, anti-gay, or other hate mongering
philosophies.
You may not provide false information or intentionally hide any information when registering for an
account.
You may not upload or transmit through or using the Services any copyrighted or trademarked content
that you do not own or have the right to without the express written permission of the author or
copyright or trademark holder.
You will not attempt to interfere with, hack into, or decipher any transmissions to or from the servers
or other facilities running the Services.
You will not exploit any bug in the Services and you will not communicate the existence of any such
exploitable bug (including bugs that grant the user unnatural or unintended benefits) either directly or
through public posting, to any other user of the Services. Bugs should be promptly reported via ‘Ask A
Question’ at https://webxotic.com/support/.
You will not attempt to play one of our Games on any server that is not controlled or authorized by
Webxotic or its designers.
You will not create, use, or provide any server emulator or other site where a game may be played, and
you will not post or distribute any utilities, emulators or other software tools related to our games without
the express written permission of Webxotic.
You may not use any third-party program (such as a “bot”) to automate gameplay functions, including
playing, chatting, interacting, or gathering items within our games. You may not assist, relay, or store
items for other players who are using these processes.
Any public discussion of disciplinary action or moderation is not allowed, and circumventing
suspensions or bans by using another account or having another user use the Services on your behalf is
also not allowed. This includes posting or sharing with third parties any chat logs or email
correspondence between a player and a Game Master (GM), moderator, administrator, or any member
of Webxotic staff.
While participating in Player-vs-Player (PvP) gameplay in the Websites or Services, you will not
participate in any form of match manipulation. Match manipulation is defined as any action taken to fix
or manipulate the outcome of a match or alter or manipulate the rankings or ratings of the ladder. This
also includes disrupting other users’ experiences in the Services by not actively participating in good faith
(e.g., “griefing” or “leeching”).
It is essential that We maintain control over content integrity and accuracy, and for that reason We have
localized our Website in English and games in English and Spanish. In the interests of quality control,
unofficial translations of our Website or Services are not permitted.
4. Choice of Law and Venue
This Code of Conduct shall be governed by and construed in accordance with the laws of the State of
Arizona, without regard to conflicts of laws principles. You hereby agree and consent that the sole
and exclusive jurisdiction for any action or proceeding arising out of or relating to this Code of
Conduct shall be the State or Federal Courts located in Maricopa County in the State of Arizona.
5. Miscellaneous
Any cause of action you may have with respect to your use of and access to the Websites or Services
must be commenced within one (1) year after the claim or cause of action arises. If for any reason a
court of competent jurisdiction finds any provision of this Code of Conduct, or portion thereof, to
be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give
legal effect to the intent of the agreement, and the remainder of this agreement shall continue in full
force and effect.
A printed version of this Code of Conduct and of any notice given in electronic form shall be
admissible in judicial or administrative proceedings based upon or relating to this Code of Conduct
or the Services to the same extent and subject to the same conditions as other business documents
and records generated and maintained in printed form by Webxotic.
The failure of Webxotic to enforce any provision of this Code of Conduct shall not be deemed a
waiver of such provision nor bar the Company’s right to enforce the provision.
